1. Who we are

This website (the "Site") is operated by Kingscove LLC, a Wyoming limited liability company, doing business as Kind Nights ("Kind Nights", "we", "us"), 2240 E 12th Street, Suite 48, Casper, WY 82609, USA. By using the Site or buying from us, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to buy from the Site. Our products are sold for delivery in the United States only.

3. Products and health information

Kind Nights products are dietary supplements. Statements on the Site have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease. Information on the Site is for general information only and is not medical advice. Ask your doctor before use if you are pregnant or nursing, have kidney problems or another medical condition, or take prescription medication. Individual results vary. Use only as directed on the label.

4. Orders, prices and payment

All prices are in US dollars. We may change prices at any time, but a change will not affect an order we have already confirmed. We try to describe our products and prices accurately. If we find an error in price or description, we may cancel the affected order and refund you in full. We may refuse or cancel any order, for example in case of suspected fraud or resale, and we will refund any amount charged. Payment is due at checkout. Applicable sales taxes are added at checkout.

5. Shipping, refunds and our guarantee

Shipping is governed by our Shipping Policy. Refunds and the Sleep-Through Guarantee are governed by our Refund Policy. Both are part of these Terms.

6. Promotions and free gifts

Free gifts (such as the e-book "The 3 A.M. Reset" included with 3 Bags + Free Gift) have no cash value, are not sold separately, and may change while supplies or the offer last. Promotions cannot be combined unless stated.

7. Intellectual property

All content on the Site, including text, images, logos, packaging design and the e-book, belongs to Kingscove LLC or its licensors and is protected by law. You may not copy, reproduce or resell it without our written permission. You may use the e-book for your own personal use.

8. Acceptable use

You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, submitting false information, or using it for any unlawful purpose.

9. Reviews and messages

If you send us a review, comment or other content, you confirm it is true and your own, and you grant us a non-exclusive, royalty-free license to use it in connection with our business. We publish only genuine reviews.

10. Third-party services

The Site uses third-party services (such as Shopify, payment processors and carriers). We are not responsible for their content or practices.

11. Disclaimer of warranties

Except as stated in our Refund Policy and as required by law, the Site and our products are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

12. Limitation of liability

To the fullest extent permitted by law, Kingscove LLC and its members, managers and partners will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or our products. Our total liability for any claim will not exceed the amount you paid for the order that gave rise to the claim. Some states do not allow these limits, so they may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Kingscove LLC from claims arising from your breach of these Terms or your misuse of the Site.

14. Governing law and venue

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Wyoming, and you consent to their jurisdiction. Nothing in this section limits rights you have under the consumer protection laws of your state.

15. Changes

We may update these Terms at any time by posting the new version on the Site. The version in effect when you place an order applies to that order.
